Terms of Service

Welcome to Smivo. Please read these Terms of Service ("Terms") carefully. By accessing or using the Smivo mobile application and website (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Account Verification

To use Smivo, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction).
• Register with a valid `.edu` university email address.
• Provide accurate and complete information during registration.

Smivo is intended exclusively for verified college students and faculty. We reserve the right to suspend or terminate accounts that provide false verification information.

2. Using the Marketplace

Smivo allows you to buy, sell, and rent items within your campus community.

2.1 As a Seller/Renter

• You must hold the legal right to sell or rent the item.
• You are responsible for the accuracy of your item descriptions, photos, and condition reports.
• You agree to honor accepted orders and communicate promptly.
• Rental deposits and duration extensions must be agreed upon mutually through the app's extension features.

2.2 As a Buyer/Rentee

• You agree to meet sellers safely at agreed-upon on-campus pickup locations.
• For rentals, you agree to return items in their original condition and on time.
• If you damage a rented item, you forfeit your deposit and may be liable for further repair costs.

3. Payments & Transactions

Smivo does not process payments directly. All financial transactions (including purchase prices, rental fees, and security deposits) are arranged between buyers and sellers outside the app (e.g., via Venmo, Zelle, or cash).

Smivo is not a party to any transaction. We do not guarantee the quality, safety, or legality of items listed, the truth or accuracy of listings, or the ability of users to complete a transaction. You assume all risks associated with transactions made through the Service.

4. Prohibited Content and Behavior

You agree not to post items or engage in behavior that:

• Is illegal, fraudulent, or violates the intellectual property rights of others.
• Involves weapons, drugs, alcohol, or adult content.
• Is harassing, abusive, discriminatory, or violates our Community Standards.
• Uses automated scripts or bots to interact with the Service.

We actively monitor content and use automated filtering. We reserve the right to remove any listing or suspend any user that violates these Terms.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Smivo and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you upload (e.g., listing photos), but you grant us a worldwide, non-exclusive license to display it within the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMIVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
3. ANY TRANSACTIONS OR MEETINGS RESULTING FROM THE SERVICE.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
